Occupational Driver's License DWI in Texas

DWI Lawyer in San Antonio, TX

After being arrested for driving while intoxicated, you will have 15 days in which to schedule an Administrative License Revocation hearing. If you do not, or you fail to show up at the hearing, your driving privileges will be automatically suspended. Driving in Texas is considered a privilege and not a right and so they can take away this privilege if you refused to take a breath or blood test or failed a breath or blood test. If you have already had your license suspended, it does not mean that you are out of options.

If you need to be able to drive in order to get to work and take care of your family, you could petition your county court. Known as an occupational driver's license (ODL), this is a temporary license which allows you to drive while your real license is suspended. This could work for more than just a DWI charge, but any offense which resulted in the loss of your driving privileges. If you believe that this would be a good option for you, the first step you should take is to secure an application and fill out all the documents required by the Department of Public Safety in Texas.

Once this has been completed, the judge will have to approve your petition. The length of time the driver is allowed to be on the road is limited, however. It could be as little as four hours a day or could be up to twelve hours a day, depending on whether the judge thinks you need that much time. On top of dealing with a DWI charge, you should not also have to risk losing your job and your ability to take care of your family.
